Smoke-Free Life is a Right

The Kosovo Advocacy and Development Centre has been actively engaged in changing and reforming anti tobacco policies and its implementation.

The protection of public health and the health of individuals from harmful effects of tobacco product consumption and exposure to tobacco smoke was the goal of the project.

KADC has actively advocated in adopting effective national legislation and in promoting measures that protects all people from tobacco smoke, exposure in all indoor public places, indoor work places, on all means of public transport.

As a result of the Project, on 26 April 2013, the President of Kosovo signed a comprehensive tobacco control law that includes the strongest protections in the world to date against tobacco industry interference in policy-making. Those measures are based on Article 5.3 of the WHO Framework Convention on Tobacco Control.

The comprehensive law mandates:

  • 100 percent smoke-free indoor public places, work places and public transportation, as well as specified outdoor areas, with some very minor exceptions.
  • Comprehensive bans on tobacco advertising, promotion and sponsorship, including a ban on retail tobacco product displays.
  • Graphic health warnings on both sides of cigarette packages.
  • Ban on misleading packaging, including descriptors such as “light” and “low”.
  •   Prohibition on sales to and by minors.
  • Ban on sales in health, education and athletic facilities.
  • Granting power to the Ministry of Health to ban ingredients as needed.
  • Constituents and emissions limits, with onerous reporting requirements formanufacturers.
  • Cessation and education measures, including 45 minutes each month of mandatoryprogramming on public radio and television.The new law incorporates nearly all measures in Guidelines to implementing FCTC Art 5.3. They apply to the whole of government and will be enforced by the national Anti-Corruption Agency. The measures include:

New Kosovo law combats tobacco industry interference

On 26 April, the President of Kosovo signed a comprehensive tobacco control law that includes the strongest protections in the world to date against tobacco industry interference in policy-making. Those measures are based on Article 5.3 of the WHO Framework Convention on Tobacco Control.The law incorporates nearly all measures in Guidelines to implementing FCTC Art 5.3. They apply to the whole of government and will be enforced by the national Anti-Corruption Agency. The measures include:

  • No unnecessary interactions between government and tobacco industry.
  • Full transparency for necessary interactions.
  • Prohibition on government partnership with, or support of, the tobacco industry.
  • Prohibition on contributions from tobacco industry to government, to government officials, and to political parties.
  • Strong tobacco-related conflict of interest provisions.
  • Despite strong tobacco industry opposition, the Parliament of Kosovo voted 72-0-2 in favor of the new law two weeks ago.
  • Forty-seven percent of youth in Kosovo have tried cigarettes before turning 18. Current cigarette use for women in the region is 44 percent, the second highest in the world.

Ligji per kontrollin e duhanit

Presidentja e Republikës së Kosovës Znj. Atifete Jahjaga me nënshkrimin e Ligjit për Kontrollin e Duhanit nënshkroi mbrojtjen e shëndetit dhe interesit publik të popullit të Kosovës.

Përveç ndalimit të pirjes së duhanit në vendet publike ky  ligji ndalon shfaqjen e produkteve të duhanit në pikat e shitjes që është një formë e fuqishme e reklamimit e përdorur nga industria e duhanit për të shitur produktet e saj dhe është veçanërisht efektive me të rinjtë dhe duhanpirësit që janë duke u përpjekur për ta lënë.

Sfida e ardhshme e shoqërisë sonë do të jetë zbatimi i këtij ligji i cili kërkon angazhimin e të gjithë qytetarëve për të sjellë një ndryshim kulturor dhe imazh ndryshe në shoqërinë tonë.

Ndryshimi kulturor do të ndodhë nëse arrijmë të përfshirje të madhe të njerëzve në monitorimin dhe zbatimin dhe duke mos e lënë atë tërësisht në duart e një grupi të kufizuar të zyrtarëve përgjegjës  për zbatim.

Mbështetja e publikut është sfida më e madhe për sigurimin e një mjedisi pa duhan në Kosovë. Kjo do të kërkojë një mobilizim të suksesshëm të opinionit publik dhe medieve, në mënyrë që njerëzit të bëhen përkrahës dhe të gatshëm për të pranuar ndryshimin. E kaluara ka treguar se ajo nuk është e mjaftueshme që  njerëzit vetëm të jenë të vetëdijshëm për dëmet e pirjes së duhanit, por ata gjithashtu duhet të jenë të vetëdijshëm për rëndësinë e qëndrueshmërisë së politikave për të mbrojtur njerëzit nga këto rreziqe.

Ky është një rast unik për qytetarët e vendit të ri që të fillojë zhvillimin e një kulture që i bindet ligjit, për të ndërtuar një shtet modern dhe të kalojë nga një shoqëri duhanpirëse në një shoqëri jo-duhanpirëse.
